Probate and Estates

Almost everything having to do with estates

Protecting Fiduciaries, Heirs, and the Public Trust

Ethical conduct is not optional in probate and estate auctions—it is the cornerstone of lawful practice. Estate auctioneers operate within a heightened fiduciary environment where transparency, informed consent, and strict avoidance of conflicts of interest are mandatory. Undisclosed self-dealing, misleading contract language, or actions taken without the Personal Representative’s knowledge or authority can expose the auctioneer to disciplinary action, civil liability, and loss of public trust.

This two-hour Continuing Education course examines the ethical foundations of auctioneering as they specifically apply to probate, estates, trusts, and court-supervised transactions. Students will explore where ethical duties originate, how they intersect with fiduciary law, and how modern estate practice demands higher standards of disclosure, documentation, and accountability.
